For an invention to be patentable in Montenegro, it should meet the following requirements :
- Novelty
An invention is said to be new, for this purpose, if it does not form part of what is known as "state of the art".
- Inventive Step
An invention is said to involve an inventive step if, at the time that the patent application is filed, it is not obvious to a person skilled in the art.
- Industrial Application
An invention is said to be capable of industrial application if it can be made or used in any kind of industry, agriculture and healthcare and in other areas.
- Patent must not fall into one of the excluded categories
Not to be regarded as inventions and therefore not patentable as such are:
- a discovery;
- a scientific theory or mathematical method;
- an aesthetic creation such as a literary, dramatic or artistic work;
- a scheme or method for performing a mental act, playing a game or doing business;
- the presentation of information, or a computer program;
- a method of treatment for the human or animal body by surgery or therapy, as well as diagnostic methods practiced on the human or animal body;
- a new animal or plant variety
