Patent General Information

Procedure for the grant :

  1. Filing the application.
  2. Formal examination.
  3. Publication of the application upon expiry of 18 months as of the filing date or as of the priority date.
  4. Patent registration and issuance of the Letters patent and specification.

- Upon publication of Patent Application, the Decision on grant is to be issued and the publication date shall be considered as grant date.

- The interested parties can file an objection to the issuance of the Decision on grant with the Board of Appeal of the Directorate for Patents and Trademarks within nine months as from the issuance of the Decision on grant.

 

Filing a National Phase of PCT Application - Requirements

- Exact and full (company) name and address of the Applicant(s) ;
- Exact and full name and address of the inventor(s) or a statement that inventor(s) does not wish to have his name mentioned in the application ;
- The published text of the PCT application including the patent description with patent title, patent claim, abstract and optional drawings.
- Priority date, country and application number, if priority is claimed. Priority Certificate is not required ;
- International Search report, if any ;
- International Preliminary examination report, if any - must be translated ;
- The Written Opinion - must be translated ;
- The answer to the Written Opinion - must be translated ;
- PCT Request, if any ;
- PCT Publication Pamphlet, issued by the International Bureau ;
- Power of Attorney, simply signed by the Applicant(s), no legalization or notarization required. It can be submitted subsequently or within a term as from the receipt of the Official Invitation. This term can be extended. A General power of attorney, to be used for a plurality of cases for the same applicant, may be accepted. (downloadable);
- Translation of description, claims and abstract into local language. Translation can be filed subsequently or within a term as from the receipt of the Official Invitation. This term cannot be extended.


Time limits for filing of National phase of PCT Application :

The Application is to be filed with the Office within 30 months as from the Priority Application date.


Duration of the patent :

20 years calculating from the international filing date.

 

The annuities/renewal fees:

The protection fees are to be paid annually, for the third year and each subsequent year, prior to the expiration of the year for which the protection fees have been paid or six months after the expiration of the protection period at the latest with 50% fine.

 

Recording changes in the Register:


Requirements for recordal of Assignment of rights

- Power of Attorney simply signed by the Assignor
- Power of Attorney simply signed by the Assignee
- Assignment document signed by the Assignor and the Assignee. Document must be legalized or notarized by Notary Public and affixed with Apostille. Must be filed in verified translation.

 

Requirements for recordal of Change of name

- Power of Attorney indicating the new name, simply signed by a representative of the Company.

- Extract from the Company Registers showing the change of name or Statement of the Secretary of State showing the change of name must be filed in verified translation.

 

Requirements for recordal Change of address

- Power of Attorney indicating the new address, simply signed by a representative of the Company
- Extract from the Company Registers showing the change of name or Statement of the Secretary of State showing the change of name must be filed in verified translation
